One of the main fields of activities of our law firm consists in offering legal and fiscal advice to foreign investors in Spain with the objective of a secure and unencumbered purchase of real estate.
As a rule, the service is made up of the following items according to the client:
- Examination of all relevant documents (e.g. extract from the Land Registry, etc.)
- Examination and advice on the fiscal aspects of the planned investment
- Conducting the contract negotiations
- Elaboration of the contract for sale and preparation of the date with the notary
- Accompanying to the notary, translation of the notarial document
- Advice on the different possibilities of payment and payment warrantees
- Handling of the transacted purchase (entry in the Land Registry, payment of the resulting taxes, etc.)
- Conclusion of architects' contracts
- Handling of the building permit procedure
- Conclusion of building contracts
- Handling of the permits necessary for the moving into/ opening of a real estate
- Conclusion of leases
- Besides the ambit of the real estate acquisition, we also work in the field of its posterior legalization such as, for instance, in the case of the builder-owner and the seller not having observed the prevailing planning law and the necessary post purchase permits not being conferred.
Further fields of work are the following:
- Promotion of a company: in any of the legally allowed forms (e.g. Sociedad de Responsabilidad Limitada)
- Enforcement of claims: letter of demand, default action, judicial enforcement
- Handling of the estate in Spain : enforcement of claims of succession of foreign citizens in Spain .
- Testamentary dispositions: last wills, etc.
- Fiscal advice for non-residents (in Spain ): declaration of income, etc.
